PROTECTING YOUR ACCOUNT
Some portions of this website permit username and passwords to be used. You are responsible for protecting your unique username and password and you agree to be responsible for all activities performed under your user account.
LICENSE AND SITE ACCESS
Stephanie Dickinson grants you (the user) a limited license to access and make personal use of this website. This license does not include the right to download any material (other than routine page caching), modify any material, or any portion thereof, without the express written consent of Stephanie Dickinson. This license excludes the download or collection of logos, product descriptions, pricing, text, graphics, audio and video clips, and/or copying account information. This website or any portion of this website may not be reproduced, duplicated, copied, sold, visited, or otherwise exploited for any commercial purpose without express written permission of Stephanie Dickinson. REDEMPTION OF FREE PRODUCT AND COUPON OFFERS
From time to time, Stephanie Dickinson offers its clients special offers and discount codes to be used in conjunction with this website. These offers are frequently disseminated via this website and through email to those who have registered for our email database. They are sometimes posted on our home page (www.Stephanie-Dickinson.com) or announced via other means of communication in conjunction with the promotion of the Stephanie Dickinson product collection, including radio and TV broadcasts, internet forums and various online websites.
We encourage our clients to redeem these special offers, but we respectfully ask that you not exploit them. Stephanie Dickinson, at our sole discretion, will determine if all purchasing criteria has been met to qualify for stated discount or free product. If you successfully circumvent the software safeguards of this website in order to receive several free products with your order, then we will (at our sole discretion) remove any extraneous free product from your order or cancel the order in its entirety. You will be informed of any order changes via the phone number or email address listed with your order.
By visiting www.Stephanie-Dickinson.com, you agree that the laws of the state of California, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Stephanie Dickinson.
CHANGES IN POLICY
Stephanie Dickinson reserves the right to modify, alter, delete and update these policies at any time we see fit. Such alterations do not nullify our rights if infringements or breaches occurred under a previous version of these conditions.
TERMS AND CONDITIONS FOR PAYMENTS AND CANCELLATIONS
1. Terms of service
Spark Retreat and Stephanie Dickinson set out what is included on the promotion page. Airfare, tips, visas, travel insurance, health and emergency insurance and alcohol are not included.
To reserve your place please complete the registration form and pay the required non-refundable deposit. Your spot is only reserved with payment of the required non-refundable deposit. Note that the deposit is non-refundable once paid.
All prices are per person and reflected in USD. All bookings include a non-refundable deposit fee that is USD $500. Refunds are available according to the cancellation terms below. Reserve your spot by paying your non-refundable deposit or paying in full.
Final payments are due 30 days before the start date of the trip to secure your spot. Note that non-refundable deposits are not refundable once paid. Refunds are available only according to conditions described below. If you do not think you can pay in time please contact us via email at Hello@Stephanie-Dickinson.com. Payment can be made by credit card or debit card.
4. Cancellations Policy & Deposits
By reserving your space by paying your non-refundable deposit, you are agreeing to the stated policies of this agreement. Please read in full. If you wish to cancel your retreat you must notify Stephanie Dickinson and Alexia Usgaard in writing. Once we’ve received your cancellation notice, cancellation will take effect subject to the following:
If cancellation takes place within 7 days of booking, 100% of your payment is refundable excluding the non-refundable deposit which is nonrefundable. However, if the Spark Retreat start date is less than 60 days from the cancellation date, your non-refundable deposits and further payment amounts toward the full price will not be refundable (as we do not offer any refunds within 60 days of the Spark Retreat.
If cancellation takes place 60 or more days prior to the retreat start date, any payments made will be refunded within 30 days of cancellation, however, your non-refundable deposit will not be refundable.
If cancellation takes place under 60 days prior to the start date all payments will be forfeited and will not be refundable.
Important: If you do not submit full payment 30 days before the retreat, and do not cancel your registration or respond to our communication expressly instructing us to cancel your registration, Stephanie Dickinson retains the right to charge the remaining balance due to the credit card provided and release your spot. Any amount forfeited, which has not then been paid to Stephanie Dickinson by you, will be recovered from you by Stephanie Dickinson as a debt due and payable to Stephanie Dickinson.
Please consider travel insurance to protect the costs of your trip in the case of injury, illness or inability to attend for other reasons.
5. Changes/Trip Cancellations
Stephanie Dickinson reserves the right to make any changes deemed necessary by our team, trip leaders, teachers or partners. In the event that we need to make a last minute change to the venue, the teacher, the itinerary, or any aspect of the retreat due to unforeseen circumstances (natural disaster, illness, civil unrest, death, closure or any other unforeseen or uncontrollable circumstance(s)) we will offer the following to our guests that do not want to attend based on changes, if any:
We will transfer your non-refundable deposit amount to a future retreat to be taken within 12 months from the date of the start date of the retreat in question. All other payments will be forfeited and Stephanie Dickinson will not be liable for refunding or reimbursing any amount beyond the transfer of the deposit to a future event.
If you choose to completely cancel your attendance at the retreat based on the changes, the cancellation terms set out above will apply (see above).
Please note that we strongly recommend that you arrange for travel insurance so that you can make a claim based on the changes and possibly have some of your expenses reimbursed by your travel insurance company, including, depending on your insurance policy, any medical and other travel complication that may occur.
In the rare case of a cancellation on the part of Stephanie Dickinson we will offer a transfer to another trip or a full refund of your funds. Your non-refundable deposit will be transferred to a future event arranged by Stephanie Dickinson within 12 months from the start date of the retreat in question.
Stephanie Dickinson is not responsible for any expenses, costs or damages incurred as a result of trip cancellation including preparation costs, airline tickets, travel documents, reservations or other expenses.
Stephanie Dickinson reserves the right to cancel the retreat 30 days prior to the retreat start date in the event that there are too few people booked for the retreat. In this case, you will be given a full refund of any and all payments made to Stephanie Dickinson, including the non-refundable deposit. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses, damage or loss (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes and reservations).
INSURANCE & DOCUMENTS
6. Travel Insurance
Stephanie Dickinson requires each trip member to purchase individual travel insurance for their trip. We suggest that you include “cancel for any reason” with your policy. You must purchase travel insurance that includes medical coverage.
7. Travel Documents and Immunizations
It is the responsibility of each traveler to obtain all required travel documents including visas and other travel documents unless otherwise noted. It is your responsibility to obtain all necessary documentation, however, you may contact us for more detailed information regarding your trip requirements. It is your responsibility to obtain any recommended or required immunizations. Please contact your nearest travel clinic for the latest requirements.
8. Acknowledgment of Risk & Assumption of Responsibility
Although Stephanie Dickinson has taken reasonable steps to ensure safety and security, you acknowledge that this activity has risks, including certain risks which are part of the nature of this activity and the retreat. The same elements that contribute to the unique character of this retreat can cause loss or damage to you including accidental injury, illness or in extreme cases, permanent trauma, disability or death and also can cause damage to or loss of property. The following describes some, but not all, of those risks.
Activities vary from trip to trip and may include but are not limited to: practicing yoga and Qi gong, hiking, backpacking and climbing in a wide variety of environments including in jungles and on rock; walking and driving on roads with a wide range of surface conditions and traffic volume; swimming.
This retreat will involve travel to remote places, oftentimes many hours from medical facilities. Transportation, evacuations and medical care can be significantly delayed; communication can be delayed, limited or not available.
Environmental risks and hazards include insects and snakes; lightning, storms, flash floods and unpredictable forces of nature, including weather changes which may change to conditions without warning. Possible injuries and illnesses include sunburn and dehydration and other mild or serious conditions.Throughout the trip, participants are responsible for their own safety.
You acknowledge and understand that Stephanie Dickinson and Spark Retreat trips include risks of injury or death to participants. I understand the description above of these risks is not complete and that other unknown or unanticipated risks may result in property loss, injury or death. I agree to assume responsibility for the inherent risks identified herein and those inherent risks not specifically identified. I acknowledge that participation in this activity is purely voluntary, no one is forcing participation and participation is elected with full knowledge of the inherent risks.
You also assume and accept full responsibility for any injury, death, loss of personal property, and expenses suffered as a result of those inherent risks and dangers identified above, and those inherent risks and dangers not specifically identified and as a result of your negligence, gross negligence or conduct in participating in this activity.
9. Release and Waiver of Liability
Declaration of death:
By accepting this Agreement you confirm that I have no physical conditions or medical precautions which would adversely affect your ability to take part in the yoga program, meditation sessions or other physical or cultural activities offered during this retreat. I fully understand that my participation in the yoga program or other activities could be injurious to my health and I voluntarily and expressly assume all risks related to such activities including other activities which form part of this retreat.
By agreeing to the terms outlined here and elsewhere on the Stephanie Dickinson (and Spark Retreat) website you, the participant, hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation on this retreat, including but not limited to damages as a result of unexpected occurrences including those from weather, local political situations, wildlife or uncontrollable acts of God, including the death and the risk thereof. You release Stephanie Dickinson including its owners, directors, employees, guides, yoga teachers, teachers, and partners from liability for personal injury, illness, emotional damage, incurred travel expenses or property damage you may incur as a result of participation on this trip.
For the benefit of everyone on your trip, Stephanie Dickinson reserves the right to accept or reject any participant at any time without liability, and in the event it determines, in its sole and exclusive discretion, that a participant is disruptive to the harmony of the trip, it may without any obligation to pay a refund or any other amount whatsoever, expel such participant from the trip. Stephanie Dickinson will not be responsible nor liable for any participant who leaves the trip prior to its conclusion or for any activity undertaken by any participant which is not included on the trip itinerary.
